Prerequisites
MP214Zk Civil Law - general part && MP311Zk Absolute Property Rights
The student should have a basic idea of ​​the functioning of the legal order, the differences between private and public law, sources of law and their interpretation, as well as basic concepts and institutes of law. Prerequisites are MP214Zk and MP311Zk.

Course objectives
The aim of the course is: - to define basic conception and notions, principles and sources of Czech Law of Obligations; - to place Law of Obligations to the system of Civil law (Private law); - to orientate students in the general part (provisions) of the Law of Obligations (IV. Part of CC) - characterize types of obligations, categorization; - to understand the concept of the contracts and tort; - to motivate students to express their own opinions about the tendencies of development of the legal regulation of Civil law in the Czech Republic; - to reflect fundamental changes in the field of Civil law.
Learning outcomes
At the end of the course students should be able to: Understand and explain the fundamental concepts, principles, and general framework of the law of obligations and civil law as well as its importance within legal systems; Acquire basic professional knowledge, skills, and capabilities; Explain basic terms and institutions of the General part of the law of obligations.

  • 1. System of law of obligations; terms: liability, debt, receivable 2. Contracting, types of contracts 3. Pre-contractual liability 4. Content of obligations, protection of the weaker party (adhesion contracts, usury, laesio enormis) 5. Change of entities of liability 6. Change in the content of the commitment, plurality of subjects 7. Securing debts (personal and substantive) 8. Securing debts, confirmation of debts 9. Fulfillment I. (place, time, way) 10. Fulfillment II. (incl. liability for defects) 11. Other ways of cessation of liabilities I. 12. Other methods of termination of the obligation II. 13. Consumer and his protection

Teaching methods
Learning is made in the form of lectures and following seminaries. The lectures have a cognitive function, seminaries are reserved for the practice of the ability to apply the legal regulation on the concrete cases. E-learning materials added.
Assessment methods
Compulsory seminar teaching, 2 continuous tests; course completed by credit (common written credit test for the whole year). Continuous homework.

Teacher's information
Conditions for completing the seminar are according to the requirements set by the teacher in the seminar at the beginning of the semester. The condition for completing the seminar for ISP is the elaboration and submission of a seminar paper on a topic assigned individually by the ISP teacher (or other approved work) and further consultation of the material of the relevant semester in the terms set by the ISP teacher and within the scope of the teaching program. In other cases, the relevant instruction of the Dean applies.
