The subject is related to the knowledge acquired in the preceding courses, especially the subject´s Introduction to Law and Administrative Law.

Course objectives
Main objective of the course is to acquaint students the administrative procedural law, not only from the theoretical point of view, but also by providing them with basic practical skills. Subject respects changes derived by the transformation of public administration and administrative law in the Czech Republic, especially in connection with the adoption of new Administrative Procedure Code.
Learning outcomes
At the end of the course students should be able to work with the sources of administrative procedural law in order to interpret and apply them in concrete cases.

  • Concept and the nature of the administrative process - public Administration - the state administration and local authorities, administrative authorities - basic concepts and institutes, the
  • Bodies of administrative proceedings - the parties - legal personality
  • Administrative procedure - the opening of the procedure - evidence - Decision
  • Specific provisions for administrative proceedings. Continuing test - a common procedure, questionable management, management location, etc. - the public authorities - ensure the evidence explanation, binding opinion
  • The proper remedies - essentials - management - drafting an appeal, degradation. Extraordinary remedies - essentials - retrial, the review procedure - failure administrative authority and defend against it
  • Judicial review of public administration - Management justice - the constitutional justice - drafting judicial administration

Teaching methods
Lectures, readings, person-to-person tuition, homeworks, partial written proofs, data mining.
Assessment methods
The course is concluded with written exam. Students are eligible to take the exam provided that they fulfill given conditions: 1. they actively participates at least 5 of workshops, 2. they hand in all practical tasks in a given extent and structure, 3. they successfully pass test (a test is regarded as successful if at least 60% of answers are correct). Detailed information is available in Instructions to study (see Study materials).
Any copying, recording or leaking tests, use of unauthorized tools, aids and communication devices, or other disruptions of objectivity of exams (credit tests) will be considered non-compliance with the conditions for course completion as well as a severe violation of the study rules. Consequently, the teacher will finish the exam (credit test) by awarding grade "F" in the Information System, and the Dean will initiate disciplinary proceedings that may result in study termination. The mentioned procedure relates to all the activities that are included in the final evaluation of the course (seminar work, essays, tests etc.).
