Course objectives
The course completes and deepens the student’s knowledge of labour law and social security law on regulation of this issue in the EU law. It aims at the aspects of the EU law in the field of free movement of workers and social policy in practice.
Learning outcomes
After passing the course students will be able to identify the fields of the labour law and social security law regulated by EU law and to define the minimum requirements stated by EU law to the Czech national law. They will be able to understand the signification and the aim of regulation of selected issue inter alia through using of interpreting approaches of the Court of Justice of the EU. Particular attention will be paid to the meaning of fundamental definitions used by EU directives and regulations concerning labour law and social security law and their interpretation in the case-law of the CJEU. Moreover, students will be able to assess the compliance of selected issue of Czech labour law and social security law with the requirements arising from the EU law.
Syllabus
  • Free movement of workers, coordination of social security systems, prohibition of discrimination based on nationality in employment, equal treatment in employment and occupation, transparent and predictable working conditions, health and safety at work, working time and rest periods, protection of young persons at work protection of motherhood, work-life balance, part-time work, fixed-term work, temporary work, collective redundancy, transfer of undertaking, protection of employees in the event of their employer’s insolvency, posting of workers.

Teaching methods
Getting to know with the content of directives and regulations relating to the social law, analyses of selected decisions of the CJEU concerning the discussed issue, discussing the meaning of the decision concerned for the EU law, Czech national law and practice.
Assessment methods
Preparation and presentation of selected issue of the labour law and social security law regulated by the EU law. The presentation should include the interpretation of the meaning and the aim of legal regulation and/or fundamental terms of the selected issue in the case-law of the CJEU and their assessment from the point of view of the application practice. The length of the presentation from 10 to 15 minutes. The evaluation includes the student s ability to answer the questions of other students and the teacher.
