- Course objectives
- The aim of the course is to provide students with the basic theoretical background in the field of refugee/migration law (definition of refugee, non-refoulement, complementary protection, role of UNHCR, admission of aliens, detention/expulsion of aliens, EU/Czech migration law, Schengen acquis, employment of aliens atc.). The course is primarily designed for students attending the concurrent all-year course of Refugee Legal Clinic, which is focused on acquiring practical skills. Since there is otherwise only limited standard preparation in theory of refugee law provided at the University, this course aims at providing theoretical basis of basic terms in the field of asylum and refugee law, so that the Refugee Legal Clinic can focus on development of practical skills. Thereby sufficient attention can be paid to migration law which is a developing field of law (especially at EU level) covering several fields of law, such as administrative law, international law and EU law. The purpose of the course is to enhance the theoretical knowledge of clinic students also by migration law; and to also allow other students not attending the clinic gain basic knowledge of this field of law. The content of individual seminars will be adjusted with the clinic, so that individual themes do not overlap but complement the seminars in the clinic (theory/practical exercises). Individual lessons are taught by experts working in asylum and migration field in practice (the office of Public Defendor of Human Rights, Supreme Administrative Court, academics, lawyers, legal counsellors at the Department of Asylum and Migration Policies, UNHCR etc.).

Asylum (Geneva Convention 1951, Protocol 1967, ECHR, EU directives, Czech Asylum Act - the legislative framework) - definition of refugee (inclusive/cessation/exclusive clauses) - principle of non-refoulement - non-penalisation for illegal entry 2. Asylum (continuation) - refugee definition - Qualification Directive x national legislation 3. Subsidiary Protection - ECHR case-law (Article 3), Qualification Directive, national legislation 4. Admission of aliens on the territory - basic theoretical concepts, ECHR case-law, procedural issues, questionable issues (transit zones etc) 5. Schengen - history, Schengen acquis, Common EU visa/readmission policy, Frontex 6. Visa/residence permits - EU level - Visa Code, EU directives, EU citizens/ EU family members/ third country nationals 7. Visa/residence permits at national level - Act on Residence of Foreigners in the Czech Republic 8. UNHCR - history, role, resettlement, extradition cases 9. Expulsion of aliens - ECHR, Return Directive, Directive No. 2004/38/ES, national legislation, remedies 10. Detention of Aliens - ENHR, ICCPR, Return Directive, alternatives to detention, national legislation, 11. EU citizen/family memeber/third country nationals - their social rights on the territory 12. Closing lecture - feedback to the students' theses
