Course objectives
The purpose of the one-semester course is to provide students with basic knowledge concerning international aspects of intellectual property protection (international treaties effective in the Czech Republic), as well as legal regulations contained in EU law, which is also binding for the Czech Republic. The main objective of the course is to understand the necessity of the international dimension of protection for individual industrial rights and copyrights and also the importance of EU law in relation to intellectual property. Attention is paid in particular to copyrights, including related rights, and trademarks.
Learning outcomes
The student will become familiar with international treaties and EU law in the field of intellectual property protection. This issue is very closely related a number of other legal disciplines. The student will have ability to evaluate the use of international and Union legal instruments in particular cases.

  • 1. international dimension of intellectual property - sources (overview of international treaties), international organizations (WIPO, WTO)
  • 2. protection of copyright and related rights under international treaties, harmonization of copyright and related rights within the EU, protection of computer programs and databases + related case law of the Court of Justice of the European Union
  • 3.: trade marks - international treaties, Madrid system for the international registration of trade marks, European Union trade mark, related case law of the Court of Justice of the European Union
  • 4. industrial designs - international registration, protection within the EU
  • 5. geographical indications and designations of origin - international and EU protection
  • 6. exhaustion of intellectual property rights

Assessment methods
Continuous study of the case law of the Court of Justice, presentation and discussion of the conclusions drawn from that case law. A final oral interview to gauge the student's knowledge.
