Abstract



At the end of this course, students will be able to understand the concept of the enforcement of foreign court judgments and arbitral awards in the Czech Republic. We will discuss the differences in the treatment of foreign court judgments from EU member states and third countries, both those with which the Czech Republic is bound by international conventions and those with which the Czech Republic has no closer relationship. Furthermore, the concept of handling foreign arbitral awards will be introduced.

Learning outcomes

At the end of this course, students will be able to:

  • understand the concept of recognition and enforcement of foreign court judgments and arbitral awards in the Czech Republic;
  • distinguish between the legal regimes for the recognition and enforcement of foreign court decisions issued:
    • in European Union member states,
    • in third countries with which the Czech Republic is bound by an international convention,
    • in third countries with which the Czech Republic has no contractual regime;
  • explain the differences in the treatment of individual categories of foreign court decisions, including their procedural requirements, obstacles to recognition and enforcement, and the role of Czech courts;
  • understand the specific status of foreign arbitral awards, their recognition and enforcement in the Czech Republic, including their distinction from foreign court decisions;
  • apply the acquired knowledge to model situations, in particular when choosing the appropriate procedure for enforcing a foreign decision or arbitral award in the Czech Republic.
