Sources of law
The aim of this seminar is to map out the main sources of law in the Czech legal system. In general, legal systems rely on sources such as written regulations, case law, normative contracts of various kinds, legal custom, legal principles, legal doctrine etc. The prominence of these sources is dependent on the individual legal system.
Czech legal system is a part of the continental law family. These legal systems are typical of their reliance on
- written regulations, incl. written constitutions
- parliamentary statutes supremacy
- secondary to none role of judicial law-making (case law, or, as they are called in Czech "judikatura")
- secondary and interpretive role of legal principles, doctrine
- practically no (or exceptional) role of legal custom
