Cíle předmětu
Researching the status of medical law in the background of specific legal sciences is an interesting academic activity. The doctrinal popularity of the term medical law, contextually, it should be believed, describing a branch of law (such as criminal law, civil law or administrative law) has a specific genesis, and the adequacy of its application is not the subject of much attention. The typical institutions of medical law include: patient's rights, medical secrecy, obligation and right to provide medical assistance, diagnostic and therapeutic risks, possibilities of medically assisted procreation versus law, selected issues of the beginning and end of human life in the context of medical law, medical experiments and scientific research in medicine, medical malpractice, relations between medical specialists, health care institutions, professional self-government. In a sense, the issue of biotechnological progress and its consequences for the "unshakeable paradigms" of the legal system is unique to medical law.
Výstupy z učení
At the end of the course, students should be able to:
- define basic issues and status of medical law in Poland;
- identify and describe, by its features, the fundamental institutions of medical law in Poland. For example: patient's rights, medical secrecy, obligation and right to provide medical assistance, diagnostic and therapeutic risks, possibilities of medically assisted procreation versus law, selected issues of the beginning and end of human life in the context of medical law, medical experiments and scientific research in medicine, treatment failures (medical malpractice), relations between medical specialists (doctors-nurses-others), health care institutions, professional self-government and other issues;
- discuss basic interpretation problems of polish medical law. Apply and solve simple legal problems arising from certain legal sources of medical law in Poland.

  • 2.Internal differentiation of the legal system. Medical law as a „branch of law” and other terms defining subsets of regulations.
  • 3.The subject of the regulation of medical law in Poland. Remarks on the sources of law.
  • 4.Institutions of medical law in Poland.
  • 5.Seminar on selected interpretation problems at the junction of medical law, bioethics and morality.
