In order to strengthen the patent protection the EU is making efforts to establish a EU patent based on the current EPO patent existing outside of the EU system. One of the significant parts of this project is the establishment of a European and EU Patents Court (EPC). The Council of the EU has prepared a draft agreement between EU Member States, other EPO Member States and EU itself on the establishment of the EPC. The Court of Justice held that the draft Agreement on the EPC is not compatible with EU law.
