In this paper will be analysed current state of relation of copyright management and the possibility of granting a licence for non-commercial use and its historical development depending on specific conditions and will be thought of possible future development in the Czech law. Specific focus will be given to the latest judgements concerning the non-commercial use and its definition. As new European directive on collective management of rights states, all the member states have to bring into their law specific provision which gives to all the right holders the possibility to licence their work for non-commercial use at the same time. This also brings again the question what is and what is not a non-commercial use, this paper will analyse latest trends and related judgements. The obligation to allow the author to grant a license for non-commercial purposes, even if the author is represented by a collective management society (CMS) means that CMSs have to overdo their current system and rethink their usual reluctance in case of author’s willingness of granting a non-commercial license. Nowadays in this case the author is facing a risk of penalisation by his collecting society. This provision is mostly targeted to on-line works so the question is whether is managing of this area by collecting society appropriate and necessary. The output of submitted article will be an analysis of current state and possible development of non-commercial use of works on the internet and role of collective management societies in this case.
