The authors of this chapter deal with free licenses in the context of the recodification of private law in the Czech Republic. Firstly authors pay attention to the definition of free licenses in Czech law and they discuss legal protection of FOSS in general. Subsequently authors focus on the contractual aspects of free licenses (contract formation, the nature and subject matter of the contract, formal requirements, interpretation of contracts, etc.). In other parts of this paper authors analyse the issue of free licenses with regard to copyright protection (economic and moral rights of authors, the collective management of copyright), public procurement and competition.
