The lecture presented the outputs of the research carried out under the grant project "Participation of Children in Juvenile Court Proceedings Concerning Custody" GAČR - GA20-12790S. Statistical data processed from the custody files of selected district courts in the Czech Republic and the conclusions drawn from these data were presented. The court's decision should always contain proper reasoning as to why the child's opinion was not ascertained in the proceedings. The child's opinion should be ascertained by the court primarily directly, not indirectly, using appropriate methods. The child's opinion should not be ascertained via one of his or her parents for the purposes of court procedure.

Přednáška prezentovala výstupy výzkumu realizovaného v rámci grantového projektu "Participation of Children in Juvenile Court Proceedings Concerning Custody" GAČR - GA20-12790S Představena byla statistická data zpracovaná z opatrovnických spisů vybraných okresních soudů v ČR a závěry, které z těchto dat vyplývají. V rámci výzkumu jsme došli k těmto zjištěním: V soudních rozhodnutích často absentuje odůvodnění proč nebyl v řízení zjišťován názor dítěte. Názor dítěte není často soudy zjišťován přímo, převažuje zjišťování zprostředkovaně, a to dokonce prostřednictvím rodičů, což je nevhodné.
