The presentation explores possible paths to creating a so-called European Commercial Court, to be a supranational forum specialized in solving of cross-border commercial disputes within the EU. Debates both among policymakers and in academia unveil numerous practical questions related to the establishment and functioning of such a Court. These include: (i) the legal basis and scope of EU competence; (ii) the necessity and added value of creating such a court; (iii) its financial viability; (iv) the applicable law, including procedural, substantive, and conflict-of-law rules; and (v) the institutional framework of the court, including its relationship with national courts, the reviewability of its decisions, and the possibility of preliminary ruling references to the Court of Justice of the European Union (CJEU). The aim of the presentation is to critically assess those questions and to provide for a legally and institutionally grounded, sustainable approach to designing and operation of a supranational commercial court, while considering the experience with the already existing international commercial courts in some Member States, as well as with the Unified Patent Court.
