Even though the EU has a functioning carbon pricing market (ETS), it is still being developed and amended. Recent changes include the full inclusion of aviation and the gradual phase-in of maritime transport. These developments also encompass the inclusion of small installations, road fossil fuel distributors, and combustion in buildings, thus forming a second emissions trading system (the so-called ETS 2). However, the implementation of ETS 2 in Member States has created political uproar, and one can expect continued debates within EU bodies on this topic. Besides the ETS, the EU has implemented the Carbon Border Adjustment Mechanism (CBAM), which aims to create a level playing field between EU and non-EU manufacturers of certain products (e.g., steel, fertilizers). Nevertheless, debates are ongoing within the WTO as to whether this instrument imposes trade barriers. In light of these recent developments, this contribution will discuss these issues.
