The paper focused on the protection of the public domain against factual re-monopolisation through trade mark law. It examined whether public-domain works, historical names and cultural symbols may be registered as trade marks without circumventing the time-limited nature of copyright protection. The analysis addressed absolute grounds for refusal under Article 7(1)(b), (c) and (f) of Regulation (EU) 2017/1001 and Article 4(1)(b), (c) and (f) of Directive (EU) 2015/2436. It also discussed the limitation of trade mark rights under Article 14(1)(b) of Regulation (EU) 2017/1001 and Article 14(1)(b) of Directive (EU) 2015/2436, as well as the genuine-use requirement under Article 18 of Regulation (EU) 2017/1001 and Article 16 of Directive (EU) 2015/2436. Using examples such as the Mona Lisa, Vigeland, Johann Sebastian Bach and Alfons Mucha, the paper argued that public-domain works must remain available for cultural, artistic and commercial reuse. It also addressed Czech law, in particular Section 11(5) and Section 28 of the Czech Copyright Act and Section 8(1) and 8(2)(b) of the Czech Trade Marks Act. The paper concluded that trade marks protect signs of commercial origin, not ownership of cultural heritage.
