The pursuit of sexual equality has been in the Community's sight since the signing of the Treaty of Rome in 1957 and continues to the present day. 14 Directives have been adopted in this area and numerous cases of the European Court of Justice have broadened the scope of EU protection against discrimination. In the Republic of Macedonia, the principle of sexual equality is enshrined in the Constitution of 1991 but it was not until 2003 that a precise anti-discrimination provision was included in any specific law. In pursuit of harmonizing the domestic law in line with the EU acquis, in 2006, the Law on Equal Opportunities for Women and Men was passed. The aim of this paper is to outline the theoretical and practical development of equality law in matters of employment, both in the EU and in the Republic of Macedonia. Primary, secondary and case law is analyzed through a comparative perspective and current conformity of Macedonian to EU law is presented. Issues like access to employment, equal pay, prohibition of discrimination, positive action, remedies and enforcement and social dialogue are being defined and elaborated. The role and the function of governmental, parliamentary, judicial independent and non-governmental bodies are also described.
