Mining law legislation – especially environmental protection in relation to mining law -belongs to actual themes. Raw materials are mined all the times and this is connected to a negative impact on the environment both during the mining operations and for years after the mine is closed. This contribution deals with two proceedings related to mineral resources protection according to the Mining Act – determination of protected deposit area proceeding and determination of mining area proceeding. The Mining Act does not correspond to the current legal circumstances. There are a lot of questions related to these proceedings but there are no clear answers. Special attention is paid to the specification of affected persons and mainstreaming of environmental protection in this area and the relation between the Mining Act and the Building Act. We try to summarize main shortcomings of current legislation in conclusion and to open professional discussion.
