In this contribution, the competence of the European Union after the Lisbon treaty in external relations was analyzed. The main emphasis was put on a problem of possible conflicts between bilateral investment treaties that have been negotiated by Member States with third states and new BITs that we can expect that will be negotiated with such states by the European Union.
