Course objectives
The aim of the course is to provide students with an insight into the field of civil procedure with regard to the students' main field of study (public administration). Attention will be paid to the basics of civil litigation and proceedings under Part 5 of the Code of Civil Procedure, enforcement and insolvency law.
Learning outcomes
After completing the course, the student should understand what civil procedural law is and what it is used for, what principles it is built on. Students should be able to understand the basic procedural institutes and their functioning.
Syllabus
  • 1) Fundamentals of Civil Procedural Law with a Focus on Part V. of Civil Procedure Code -the course of civil litigation proceedings before the court of first instance, appeal proceedings -proceedings under Part V. of Civil Procedure Code and competence disputes 2) Fundamentals of Enforcement Law -basic background of the law of execution --relationship of the search procedure and the execution procedure (procedure for execution --decision) --relationship of the procedure for enforcement of a decision under Part Six of the Code of Civil Procedure and --execution under the Execution Code --principles of enforcement proceedings --factual prerequisites for ordering execution --execution title -procedure of enforcement proceedings 3) Basics of Insolvency Law -bankruptcy --insolvency --indebtedness -debtor, creditors and creditor bodies -insolvency petition -initiation of insolvency proceedings and their effects -decision on the insolvency petition

Teaching methods
Teaching takes the form of a block of lectures.
Assessment methods
The course ends with an exam. The exam will take the form of a written test written en masse at the faculty. The test will consist of 10 questions with four yes-no options (one of the options must be ticked); -for each correct answer the student will receive 1 point; for incorrect and unmarked answers the student will lose -0.25 points; -the maximum number of points is 40; -a minimum of 20 points is required to pass the test; - there is a time limit of 22 minutes to complete the test. The subject of the test will be knowledge of the material covered in lectures and the materials and literature referenced in the syllabus. You must register for the test date via IS. The use of legal regulations is permitted during the test. Evaluation of the exam will be based on the post scores obtained in the written test: 40 to 37 points (37.00 to 40.00 points) - A 36 - 33 pts (33.00 to 36.75 pts) - B 32 - 28 pts (28.00 - 32.75 pts) - C 27 - 24 pts (24.00 - 27.75 pts) - D 23 - 20 pts (20,00 - 23,75 pts) - E 19 points or less (19,75 - 0,00 pts) - F
