- Course objectives
- This module is supposed to guide the participants to understand substantial concepts of Administrative Law and Public Administration in their full sense and context within the conditions of the modern democratic legal state (Rule of Law). This module will enable students to: • Understanding of regulatory role of Administrative Law. • Knowledge and possibility of use public methods and forms of regulation in practice. • Analytic view on the Administrative Law as a structured regulatory system influencing social life. • Gaining sufficient knowledge of European format and content of Administrative Law. • Knowledge and possibility of use argumentation by principles of European Administrative Law in the particular situations. • Understanding of the structure and functioning mechanism of the Administrative bodies’ structure, including its interrelationships. • Analytic view on the sphere of entities executing Public Administration, their obligations, entitlements and liability. • Understanding of the inner and external supervision mechanism of Public Administration. • Reflection of the interrelationship between the controlling institutions and mechanisms on the one hand and its use in the practice on the other hand. • Development of knowledge concerning the legal guarantees system of legitimate and proper administrative bodies´ functioning. • Understanding and reflection upon the review mechanism of the administrative bodies´ decisions or inactivity that prevent public interest’s protection and individual rights´ protection. After completion of the module the students should be able to: a) fully understand and apply terminology of Administrative Law and Public Administration. b) present and explain internal system and structuring of Administrative Law, content of the term “European Administrative Law” and the interrelationships between those terms. c) identify and reflect upon the legal sources of Administrative Law, including European, constitutional and domestic legal sources. d) discuss the role of Administrative Law Principles and their application in administrative experience. e) analyze Public Administration’s organizational structure and its particular components. f) analyze legal status of entities executing Public Administration, their obligations and entitlements, concept of Public Administration as a citizen’s service. g) understand interaction between aims and objectives of Public Administration and particular forms of Public Administration’s activities. h) discuss inner and external supervision mechanism of Public Administration. i) understand the legal guarantees system of Public Administration’s proper functioning and foundation of proper functioning of its particular components. j) identify and analyze solutions and arguments in a systematic and coherent way that demonstrates an understanding of the complexities of Administrative Law and Public administration, including application of relevant judicature. k) communicate and formulate her/his knowledge and arguments professionally and linguistically correct and in a way that is structured and coherent.
