Course objectives
This module will enable students to: • understand basic issues of criminal liability • acquire an overview of the system of criminal sanctions • understand the various forms of economic crimes from the viewpoint of criminal law substantive and procedural, criminalistics and criminology • understand how to apply the knowledge acquired in their entrepreneurial and managerial • practical activities as well as for the protection of the entity they work for. After completion of the module the student should be able to: a) recognise the issues concerning the conditions of criminal liability and imposition of sanctions b) analyse individual forms of economic crimes from the point of view of criminal law, criminalistics and criminology c) have knowledge of the procedural issues relating to investigation of economic crimes d) apply the knowledge acquired in their practical activities e) have knowledge of EU activities in the field of criminal law, especially money laundering, fraud etc.
Syllabus
  • The module addresses the following topics: Introduction to the selected problems of criminal liability and criminal sanctions (definition of crime, body of crime and the danger to society, system of penalties and protective measures) and introduction to criminal procedure (subjects of criminal prosecution, stages in criminal procedure). Particular forms of economic crimes: • Crimes on the capital market • Crimes in the sphere of services • Crimes in the sphere of trade (business) • Crimes in the sphere of privatisation of state property • Crimes relating to taxation • Crimes against economic discipline • Crimes relating to bankruptcy and composition proceedings All these form will be presented from the following points of view: Definitions of concepts, legislative framework of particular activities, European law context, typical ways of committing crimes, methods and means of discovering such crimes, possibilities for criminal sanctions, prevention of crime, topical statistical data.

100 % written assignment Type and Weighting of Methods within Each Element This module is assessed by means of a written assignment (2,000 to 3,000 words) Illustrative assignment and assessment criteria: Course assignment is aimed at solving different aspects of a particular case of economic crime. An answer to this question would be assessed against the following criteria: 1. Methods of producing an assignment 2. Conclusions 3. Logical reasoning 4. Closing arguments from the point of view of the counsel for the prosecution and defence
