Course objectives
The purpose of this one-semester course is to provide students the basic knowledge relating to the international aspects of protection of the intellectual property rights (international treaties) and the legal regulation contained in the EU law. The main objective of the course is the understanding of a necessity of the international dimension of protection of the particular industrial property rights and copyright. Students will be provided with the ability to find appropriate methods and means of protection in various cases.
Syllabus
  • 1. International dimension of the intellectual property, sources (an overview of the international treaties), international organizations (WIPO, WTO)
  • 2. Protection of copyright and related rights under international treaties, harmonization of copyright and related rights in the EU, digital environment, protection of computer programs and integrated circuits
  • 3. Industrial designs – international registration, protection within the EU
  • 4. Trademarks – international treaties, the Madrid system for the International Registration of Marks, Community trademark, related case-law of the Court of Justice of the European Union
  • 5. Geographical indications and designations of origin - international and EU protection
  • 6. Patents – basic concepts, international treaties, another protection of inventions, PCT and EPC, EU "unitary patent"
  • 7. Disposition with the intellectual property rights - international license and franchising contract
  • 8. Remedies of protection and enforcement of rights
  • 9. Exhaustion of intellectual property rights
