Course objectives
The course is focused on asylum and immigration law, dealing not only with Czech legislation, case-law and to some extent also with the European asylum acquis and with the relevant international conventions (Geneva Convention, European Convention on Human Rights). The theory lessons are complemented by practical exercises in which students may try to write an appeal and other legal submissions, they may take part in a moot court, etc. Feedback is provided not merely by the teacher but also by invited external lecturers. The lessons are also complemented by practice in a local NGO, OPU, which provides free legal counselling to asylum-seekers and other aliens. Practice includes not merely visits of the NGO, but also travelling to detention and asylum centres run by Ministry Interior. Students may see the legal counsellors of NGOs in practice and are also given opportunity to provide legal counselling themselves. Apart from (non-exhaustive) theoretic basis of asylum and immigration law, the course aims to show students what work of a lawyer in an NGO requires, and how to provide assistance to a specific group of persons who are often dependent on the assistance of NGOs. The students are also - in seminars - given opportunity to try what later in their legal practice will influence the results of disputes.
Syllabus
  • 1. Oral argumentation before a court in asylum matters - a role-play training 2. Reflection of individual asylum cases in cooperation with an NGO, students carry out a pleading on behalf of the asylum seekers to support their case before the Ministry during their practice in the semester. 3.-4. Argumentation workshop and presentation of oral argumentation before a court in asylum matters, 5. Expulsion, detention of foreigners, consideration of reasons forbidding the state to expulse a foreigner. 6. Protection of stateless persons under international and national law, case studies and reflections from practice.
