Arbitral procedure – overview

Introduction

Generally, arbitral procedure is not governed by strict procedural rules as court proceedings. National arbitration laws usually contain the basic principles that must be observed and general procedural rules. The core principle that is provided by national arbitration laws and that must be observed is the right of the parties to a fair trial and equality of the parties. Parties to arbitration are free to agree on the procedure provided that the mandatory rules of lex arbitri are respected. In this regard, parties often refer to institutional arbitration rules. The arbitral tribunal has broad power as regard procedural matters provided that the mandatory rules of lex arbitri and agreement of the parties are respected.

The aim of this chapter is to provide an overview of arbitral procedure including the examples of legal regulation. After going through this chapter a student should be able: to explain the regulatory framework of this issue; to provide an overview of usual phases of arbitral procedure including their regulation in UNCITRAL Model Law and selected arbitration rules (e.g. ICC Rules); to explain the importance of IBA Rules on Taking of Evidence.
