Course objectives
At the end of this course the student: has theoretical and practical knowledge about the importance of administrative procedural law in the system of administrative law with the ability to apply basic principles of administrative law; is properly oriented in various procedural practices of administrative bodies; will acquire an overview of relevant case law; will be able to apply theoretical and case law conclusions on specific cases; will be able to make submissions and formulate decisions of administrative bodies and courts.
Syllabus
  • Introduction to the course and its organisation and content, literature and basic jurisprudence, conditions for passing the course, the scope, content and structure of the Administrative Code, the basic principles of administrative law, a complaint.
  • Part fourth to seventh of the Administrative Code, judicial protection.
  • Administrative procedure and its principles. Participants of administrative proceedings and their acts. Problematic areas of administrative procedings and the most frequent mistakes in administrative proceedings according to the courts. Initiation of administrative proceedings, a motion to initiate administrative proceedings, ex officio initiation of the proceedings, essentials of the application and of the motion to initiate proceedings.
  • Administrative proceedings - pre-trial procedure and procedure in the first instance. Administrative proceedings; basis for the decision and evaluation data for decision according to the jurisprudence. Deadlines for issuing decisions, protection against inactivity, the most common defects and mistakes in the conduct of administrative bodies. Practical demonstration and familiarization with the administrative file, its layout, defects and specifics.
  • Administrative decisions - structure of the decision of the administrative authority of the first degree and its essentials, defects and mistakes; costs. A practical demonstration of the actual administrative decisions in the field of the right to international protection, administrative delicts and infractions, taxes, construction, social security, etc., and their analysis (especially in terms of specifics).
  • Review of administrative decisions under the Administrative Code. A practical demonstration of the appeal, including the problematic of argumentation. Decisions on appeals, its essentials and structure. A practical example of an administrative decision in the second degree.
  • Judicial control of public administration, place and tasks of the administrative judiciary, proceedings before the administrative courts, application, types of actions, time limits for bringing an action, the issue of argumentation. A practical example of the application.
  • The proceedings before the administrative courts, the types of decisions of administrative courts, costs, requirements of law. Practical demonstration of different types of appeals and orders (suspension, dismissal, appointment of a representative of an action, the exemption from court fees) and their analysis.
  • The Supreme Administrative Court, judicial protection in the field of administrative justice, the proceedings before the Supreme Administrative Court, an appeal in cassation, requirements of the law. Practical demonstration of a cassation complaint (in different versions)
  • Practical example of the resolution of the Supreme Administrative Court (staying the proceedings, refusal of the application, refusal for unacceptability in matters of international protection). Proceedings under Part V of the Civil Procedural Code, the proceedings before the Constitutional Court.
  • Revision and final test.
  • Summary and Review. Final discussion. Verification whether the students satisfied the conditions for passing the course.
