Prerequisites
The basic prerequisite for the initiation of course Private International Law is at least a basic knowledge of Czech private law - civil and commercial.This is not determined by formal criteria, but is assumed.

Course objectives
The course PIL I gives to the student a comprehensive overview of the rules and institutes in private internatinal law. Main objective of the course is to understand the legal regulation of the cross border relationships. The particular goals could be summarized as follows: to understand the history of the PIL, the doctrines of the PIL, the general part of the PIL and the particular parts of the conflict law, to be able to work with the sources of the PIL, to understand the choice of law rules in different area of the PIL. At the end of the course the student should be able to use the different sources of the PIL and to solve the simple cases from this area.
Learning outcomes
Student will: - gain knowledge of the basic principles and legal rules of PIL - identify the situation in the area of private law with foreign element - gain knowledge in the area of european private international law - learn to apply the konwledge they acquire to identify and solve concrete problems that arise in international (civil and commercial) area.

  • Lectures in Private International Law Lectures in Private International Law I are focused on the improvement of some difficult issues and themes. I. Private International Law, history, development of the doctrine. II. Sources of the PIL - european directives and regulations, national acts - codification of PIL, international treaties and Model Acts. Conflicts of the conventions. Private Law and Public law in the transnational area. III. The solution of the conflict of law. Conflict of law method and uniform law method as the basic method of the PIL. IV. Conflict of law method. Choice of law rules. V. Conflict of law - general part. Clasification. The incidental question. VI. Conflict of law - general part. Renvoi. The proof of foreign law. VII. Public policy. The exclusion of foreign law. VIII. International mandatory rules. IX. Special part. The law of contract. The Convention Rome I. The Regulation Rome I. X. The law of property. XI. The law of torts and delicts. The Regulation Rome II. XII. Family and children from the point of view of choice of law. XIII. Succession and choice of law.
