Course objectives
The course on „Church Law“ introduces main aspects of constitutional freedom of religion, confessional law and development of church and state relations in the Czech Lands since 19th century. From comparative point of view, the situation in some other European countries and the USA shall be described, as well as case-law of the European Court of Human Rights and other international jurisprudence (Concordats).
Syllabus
  • The concept of ecclesiastical law and confessional law.
  • The development of confessional law and religious freedom in our territory since the 19th century.
  • Freedom of religion as an individual and collective constitutional right (Articles 15 and 16 of the Constitution)
  • Confessional law in the Czech Republic (Act No. 3/2002 Coll. and others)
  • Church education.
  • Clerical ministry in the army and the police. Prison ministry.
  • Criminal law protection of freedom of belief and religion. Confidentiality and criminal proceedings.
  • Social and health care ministry. Legal status of charities, diakonia and church hospitals.
  • Proceedings for registration of religious communities. Registration of ecclesiastical legal persons. State cult administration and its tasks.
  • Status of clergy and economic security of churches
  • Church marriages. Religion and the family.
  • Restitution of church property - development and current status
  • Relevant case law of the Constitutional Court and the European Court of Human Rights
  • International law aspects of confessional law. Contract and concordat law.
  • Models of church-state relations in selected European countries and the USA.
  • Churches and religious societies in the Czech Republic, overview, internal structure.
