Course objectives
This course targets the issues of ownership and the environmental protection, i.e. restriction of property rights in favour of environmental protection (including compensations), on one hand, and possible use of property rights for the protection of the environment, on the other. Special attention is focused on types and functions of economic instruments used in environmental law.
Learning outcomes
After completing the course, a student will be able to: identify owners of different parts of the environment; find and analyse relevant judgements; describe the reasons to restrictions of property right for the protection of environment; explain the factors influencing the scope of the compensation for limiting proprietary rights; propose convenient use of property rights to environment protection; apply principles of economic instruments used in environmental law.

  • 1. The constitutional framework of property rights with respect to environmental protection. 2. Ownership of components of the environment. 3. Restriction of property rights on account of environmental protection. 4. Compensation for limiting property rights on account of environmental protection. 5. Use of property rights to protection of the environment. 6. Limitation of enterprising with in order to environmental protection. 7. The system and functions of economic instruments in environmental law.

Reading of recommended texts and judgements. Occasional consultation.
Assessment methods
Presentation of written work; its topic will be determined at the start of the semester. The work can take one of the following forms: analysis of the current problem, review of the monograph and analysis of case law in the selected area.
