Course objectives
By the successful completion of the course, students should have basic theoretical and practical knowledge of the area of judicial review of public administration law. They should be able to explain relations among various types of judicial review. In addition, by using the practice of courts, they should be able to suggest a solution of propounded case studies, including the ability to give reason for the solution.
Syllabus
  • The term and nature of judicial control of public administration, public administration and justice, their interrelation, characteristic of model systems of judicial control of public administration, historical development of administrative justice in the Czech Republic, the present state of judicial review of public administration, theoretical approaches to the judicial control of public administration, judicial control of public administration de lege ferenda. Judicial Control of Public Administration Basic concepts and institutions of administrative justice; Systems of judicial control over state administration; History of Czech administrative justice; Organization of administrative justice; Constitutional regulation of administrative justice; Principles of legal regulation; Decision-making in Actions against administrative agency decisions; Decision-making in remedies against administrative agency decisions.
